Terms and conditions
The terms and conditions that apply when you order from Rince. They are also there to protect you — where the law grants you more rights than this document, the law prevails.
You have a 14-day statutory cooling-off period, and on top of that, Rince gives you 100 days to actually use the shower head. If you don't like it, you get your money back and we pay for the return shipment. Prices include VAT. We deliver within 30 days — in practice 9 to 12 days. This summary is intended for readability; in case of doubt, the articles below apply.
Definitions
In these terms and conditions, the following definitions apply:
- Ancillary agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract, and these goods, digital content and/or services are supplied by Rince or by a third party based on an agreement between that third party and Rince;
- Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
- Consumer: the natural person who is not acting for purposes relating to their trade, business, craft or profession;
- Day: calendar day;
- Digital content: data produced and delivered in digital form;
- Continuing performance contract: a contract for the regular delivery of goods, services and/or digital content over a specified period;
- Durable medium: any means — including email — that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows for future consultation or use for a period appropriate to the purpose for which the information is intended, and which allows for the unchanged reproduction of the stored information;
- Right of withdrawal: the consumer's option to withdraw from the distance contract within the cooling-off period;
- Model withdrawal form: the European model withdrawal form included in Annex I of these terms and conditions;
- Distance contract: a contract concluded between Rince and the consumer within the framework of an organized system for distance selling of products, digital content and/or services, whereby, up to and including the conclusion of the contract, exclusive or partial use is made of one or more means of distance communication;
- Rince: the company further described in Article 2, which offers products, (access to) digital content and/or services at a distance to consumers under these general terms and conditions;
- Means of distance communication: a means that can be used for concluding a contract without the consumer and entrepreneur needing to be simultaneously present in the same room.

Applicability
- These general terms and conditions apply to every offer from Rince and to every distance contract concluded between Rince and the consumer.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, Rince will indicate, before the contract is concluded, where the terms and conditions can be inspected and that they will be sent free of charge upon request.
- If the contract is concluded electronically, the text of these terms and conditions may be made available to the consumer electronically, in such a way that it can be easily stored on a durable data carrier. If this is not reasonably possible, before the contract is concluded, it will be indicated where the terms and conditions can be consulted electronically and that they will be sent free of charge upon request.
- If, in addition to these terms and conditions, specific product or service conditions also apply, the second and third paragraphs apply mutatis mutandis. In the event of conflicting terms and conditions, the consumer can always invoke the provision that is most favorable to them.
The offer
- If an offer has a limited period of validity or is made under conditions, Rince will explicitly state this in the offer.
- The offer contains a complete and accurate description of the products, digital content, and/or services offered, detailed enough to allow for a proper assessment of the offer. If Rince uses images, they are a true representation. Obvious mistakes or errors in the offer are not binding on Rince.
- Every offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer.
The agreement
- The agreement is concluded, subject to paragraph 4, at the moment the consumer accepts the offer and fulfills the conditions set therein.
- If the consumer has accepted the offer electronically, Rince will immediately confirm receipt thereof by electronic means. As long as this confirmation has not been sent, the consumer can dissolve the agreement. After that, the right of withdrawal from Article 6 remains fully applicable, and the consumer can also cancel their order free of charge as long as it has not yet been shipped.
- If the agreement is concluded electronically, Rince will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If the consumer can pay electronically, Rince will observe appropriate security measures.
- Rince can, within legal frameworks, inquire whether the consumer can meet their payment obligations, as well as all facts and factors that are important for a responsible conclusion of the agreement. If Rince has good reasons not to enter into the agreement based on this inquiry, Rince is entitled to refuse an order with justification or to attach special conditions to its execution.
- Rince will send the following information no later than upon delivery, in writing or in such a way that the consumer can store it accessibly on a durable data carrier:
- the address where the consumer can file complaints;
- the conditions under which and the manner in which the consumer can exercise the right of withdrawal, or a clear statement that the right of withdrawal is excluded;
- information about guarantees and after-sales service;
- the price including all taxes, the delivery costs if applicable, and the method of payment, delivery or execution;
- the requirements for termination if the agreement lasts longer than one year or is for an indefinite period;
- the model withdrawal form, if the consumer has a right of withdrawal.
- In the case of a continuing performance contract, the previous paragraph only applies to the first delivery.
Right of withdrawal
For products
- The consumer can dissolve an agreement for the purchase of a product during a reflection period of at least 14 days without giving reasons. Rince may ask why, but may not oblige the consumer to give that reason.
- This reflection period starts on the day after the consumer, or a third party designated by him in advance who is not the carrier, has received the product, or:
- if the consumer has ordered several products in one order: the day on which the last product was received. Rince may refuse an order of several products with different delivery times, provided that this has been clearly communicated in advance;
- if the delivery consists of several shipments or parts: the day on which the last shipment or the last part was received;
- in case of regular delivery over a certain period: the day on which the first product was received.
For services and digital content not supplied on a tangible medium
- The consumer can dissolve a service agreement and an agreement for digital content not supplied on a tangible medium for at least 14 days without giving reasons.
- This reflection period starts on the day following the conclusion of the agreement.
Extension if Rince has not provided adequate information
- If Rince has not provided the legally required information about the right of withdrawal or the model form, the reflection period expires twelve months after the end of the original reflection period.
- If Rince provides that information within those twelve months, the reflection period expires 14 days after the day on which the consumer received the information.
Rince gives the consumer 100 days from receipt to try out the product under their own shower. If it is not satisfactory, the consumer will receive a refund of the purchase price. This promise is an additional guarantee as referred to in Article 12 and is in addition to the statutory reflection period of 14 days — it does not replace it and does not limit it.
Consumer's obligations during the reflection period
- During the statutory reflection period, the consumer will handle the product and its packaging with care. He will only unpack or use the product to the extent necessary to ascertain its nature, characteristics, and functioning. The basic principle is that he may handle and inspect the product as he would be allowed to do in a shop.
- The consumer is only liable for any diminished value of the product resulting from handling it in a way that goes beyond what is permitted in paragraph 1.
- The consumer is not liable for diminished value if Rince has not provided him with all legally required information about the right of withdrawal before or at the time of concluding the agreement.
Within the 100-day trial period, Rince will not charge for diminished value due to normal use. The shower head can be taken out of the box, attached to the hose, and used in the shower — otherwise, it can't be tried out. Paragraph 1 above is the legal minimum; Rince's promise consciously goes beyond that.
Exercise of the right of withdrawal and its costs
- If the consumer exercises his right of withdrawal, he shall notify Rince of this within the reflection period using the model withdrawal form (Appendix I) or in another unequivocal manner. An email to support@rince.nl is sufficient.
- As soon as possible, but in any case within 14 days after that notification, the consumer shall return the product or hand it over to Rince or an authorised representative. This is not necessary if Rince has offered to collect the product itself. The consumer has in any case complied with the deadline if he returns the product before the reflection period has expired.
- The consumer shall return the product with all supplied accessories, if reasonably possible in its original condition and packaging, and in accordance with the reasonable and clear instructions provided by Rince.
- The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lie with the consumer.
- Rince bears the direct costs of returning the product. The consumer receives a return label or will be reimbursed for the shipping costs. This provision consciously deviates from the statutory main rule, to the consumer's advantage.
- The consumer shall not bear any costs for the delivery of digital content not supplied on a tangible medium, if:
- he has not expressly consented to the commencement of the performance before the end of the reflection period;
- he has not acknowledged losing his right of withdrawal when giving that consent; or
- Rince has failed to confirm that declaration.
- If the consumer exercises his right of withdrawal, all supplementary agreements will be dissolved by operation of law.
Rince's obligations upon withdrawal
- If Rince makes electronic notification of withdrawal possible, Rince will send an immediate confirmation of receipt after receiving that notification.
- Rince will reimburse all payments from the consumer, including any delivery costs charged by Rince for the returned product, without delay but no later than 14 days after the day on which the consumer notifies of the withdrawal. Unless Rince offers to collect the product itself, Rince may wait with repayment until the product has been received or until the consumer demonstrates that he has returned it — whichever comes first.
- Rince will refund using the same payment method the consumer used, unless the consumer agrees to a different method. The refund is free of charge for the consumer.
- If the consumer has chosen a more expensive delivery method than the cheapest standard delivery, Rince is not obliged to reimburse the additional costs for it.
Exclusion of the right of withdrawal
Rince can exclude the products and services mentioned below from the right of withdrawal, but only if Rince has clearly stated this in the offer, or at least in good time before the conclusion of the agreement:
- products manufactured according to the consumer's specifications, which are not prefabricated and are manufactured on the basis of an individual choice or decision of the consumer, or which are clearly intended for a specific person;
- sealed products which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;
- products that spoil quickly or have a limited shelf life;
- products that are irrevocably mixed with other products by their nature after delivery;
- services that have been fully performed, but only if the performance has begun with the express prior consent of the consumer AND he has declared that he loses his right of withdrawal as soon as Rince has fully performed the agreement;
- digital content not supplied on a tangible medium, under the same two conditions;
- products or services whose price is subject to fluctuations in the financial market over which Rince has no control and which may occur within the withdrawal period.
Nothing. Every product in the webshop — the shower head, filters, and capsules — falls under the full right of withdrawal AND the 100-day trial period. If this ever changes for a specific product, it will be stated with that product before you order.
The price
- During the validity period stated in the offer, prices will not be increased, except as a result of changes in VAT rates.
- Notwithstanding this, Rince may offer products whose prices are subject to fluctuations in the financial market over which Rince has no influence, with variable prices. This dependence, and the fact that stated prices are target prices, will be mentioned in the offer.
- Price increases within 3 months of the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.
- Price increases from 3 months after the conclusion of the agreement are only permitted if Rince has stipulated this AND they are the result of statutory regulations or provisions, OR the consumer has the right to terminate the agreement on the day the increase takes effect.
- All prices mentioned in the webshop include VAT. Shipping costs are shown separately in the shopping cart before the consumer checks out.
Performance of the agreement and additional guarantee
- Rince guarantees that the products comply with the agreement, the specifications stated in the offer, reasonable requirements of soundness and usability, and the statutory provisions applicable on the date the agreement was concluded. If agreed, Rince also guarantees that the product is suitable for other than normal use.
- An additional warranty provided by Rince, a supplier, manufacturer or importer, never limits the statutory rights and claims that the consumer can assert against Rince on the basis of the agreement.
- Additional warranty means: any commitment by Rince, a supplier, importer or producer that grants the consumer rights or claims that go beyond what is legally required.
- Rince provides a 100-day trial period as an additional warranty: if the product is not satisfactory, the consumer will receive their money back within 100 days of receipt, and Rince will pay for the return shipment. The consumer's statutory rights, including the right of withdrawal and the right to a sound product, remain fully applicable in addition to this.
Delivery and execution
- Rince will exercise the greatest possible care in receiving and executing orders.
- The place of delivery is the address that the consumer has made known to Rince. Rince delivers in the Netherlands and Belgium.
- Rince will execute accepted orders with due speed, but at the latest within 30 days, unless a different delivery period has been agreed upon. The expected delivery time is 9 to 12 days; this is an indication and not a strict deadline. If delivery is delayed, or if an order cannot be executed or can only be partially executed, the consumer will be notified thereof at the latest 30 days after placing the order. They then have the right to dissolve the agreement without costs, and the right to any compensation.
- After dissolution in accordance with the previous paragraph, Rince will immediately refund the amount paid by the consumer.
- The risk of damage and/or loss of products rests with Rince until the moment of delivery to the consumer or to a pre-designated representative made known to Rince, unless expressly agreed otherwise.
- Shipping costs are shown before checkout. Above the threshold amount stated in the webshop, Rince ships free of charge.
Long-term transactions: duration, termination and extension
Rince does not currently offer subscriptions. This article only applies if an agreement for regular delivery is concluded.
Termination
- The consumer may terminate an agreement entered into for an indefinite period, which extends to the regular delivery of products or services, at any time, with due observance of the agreed termination rules and a notice period of no more than one month.
- The consumer may terminate an agreement entered into for a definite period, which extends to the regular delivery of products or services, at any time at the end of that definite period, with due observance of the agreed termination rules and a notice period of no more than one month.
- The consumer may terminate the agreements mentioned in the previous paragraphs:
- at any time, and not be limited to termination at a specific time or during a specific period;
- at least in the same way as they were entered into;
- always with the same notice period as Rince has stipulated for itself.
Extension
- An agreement entered into for a definite period, which extends to the regular delivery of products or services, may not be tacitly extended or renewed for a definite period.
- Notwithstanding this, such an agreement may be tacitly extended for a definite period of up to three months, if the consumer can terminate that extended agreement at its end with a notice period of no more than one month.
- Such an agreement may only be tacitly extended for an indefinite period if the consumer may terminate it at any time with a notice period of no more than one month.
Duration
- If an agreement lasts longer than one year, the consumer may terminate it at any time after one year with a notice period of no more than one month, unless reasonableness and fairness oppose termination before the end of the agreed duration.
Payment
- Unless otherwise stipulated in the agreement or in additional terms and conditions, the amounts owed by the consumer must be paid within 14 days after the cooling-off period commences, or, if there is no cooling-off period, within 14 days after the conclusion of the agreement. In the case of a service agreement, this period begins on the day after the consumer has received confirmation. In practice, payment is made directly upon ordering in the webshop.
- When selling products to consumers, the consumer may never be obliged to pay more than 50% in advance in the general terms and conditions. If advance payment has been stipulated, the consumer cannot assert any right to the execution of the order before that advance payment has been made.
- The consumer must immediately report inaccuracies in provided or stated payment details to Rince.
- If the consumer fails to meet their payment obligation on time, they will owe statutory interest on the outstanding amount — after Rince has informed them of the late payment and granted them a period of 14 days to still pay — and Rince may charge extrajudicial collection costs. These amount to a maximum of 15% on outstanding amounts up to €2,500, 10% on the subsequent €2,500 and 5% on the next €5,000, with a minimum of €40. Rince may deviate from these amounts and percentages in favor of the consumer.
Complaints procedure
- Rince has a sufficiently publicized complaints procedure and handles complaints in accordance with that procedure.
- Complaints about the execution of the agreement must be submitted to Rince, fully and clearly described, via support@rince.nl, within a reasonable time after the consumer has discovered the defects.
- Rince will respond to a complaint within 14 days of the date of receipt; in practice, we aim to respond within one working day. If a complaint requires a foreseeably longer processing time, Rince will send an acknowledgment of receipt within those 14 days with an indication of when the consumer can expect a more detailed answer.
- If the consumer cannot resolve the issue with Rince, they can request free advice from ConsuWijzer, the information desk of the Authority for Consumers & Markets, or submit the dispute to the competent court.
Disputes
- Agreements between Rince and the consumer to which these general terms and conditions relate are governed by Dutch law. If the consumer resides in another EU Member State, they also retain the protection of the mandatory provisions of the law of their country of residence.
- Disputes will be submitted to the competent court in Amsterdam. The consumer always has the right to choose the court that is competent under the law — usually the court of their own place of residence — within one month after Rince invokes this provision.
Additional or deviating provisions
Additional provisions, or provisions that deviate from these general terms and conditions, may not be to the detriment of the consumer. They must be recorded in writing, or in such a way that the consumer can store them in an accessible manner on a durable data carrier.
Appendix I · Model withdrawal form
You do not have to use this form — an email stating that you are cancelling the purchase is sufficient. If you do wish to fill it out, you can do so as follows. Send it to support@rince.nl.
